Terms and conditions
These terms apply to every proposal and every job. In short: you get a fixed price up front, extra work only happens with your say-so, and once paid, what I make for you is yours.

1. Who and when
These terms apply to all proposals, jobs and subscriptions of Neal Van de Velde, company number , (contact@nealvdv.be). Other terms only apply if we agree so in writing.
2. Proposal and price
A proposal is valid for 30 days. Its price is fixed and excludes VAT, unless stated otherwise.
Work that isn’t in the proposal only happens after your written agreement (an email will do), at € 85 an hour or under a separate proposal.
3. Working together and planning
I do everything reasonable to meet the agreed planning (a best-efforts obligation). You provide the copy, photos and access needed in time. If they come later, the planning moves by as much.
4. Payment
- Websites, webshops and software: 50 % at the start, 50 % on delivery, unless agreed otherwise. Paying in instalments is possible by arrangement.
- Subscriptions (hosting and maintenance): monthly or yearly in advance.
- Invoices are payable within 14 days.
For late payment by a business, the statutory interest of the Belgian Act of 2 August 2002 on combating late payment in commercial transactions applies. For consumers, statutory interest applies after formal notice. After a reminder without result, I may suspend work and hosting.
5. Delivery and guarantee
After delivery you have 14 days to send remarks. Without remarks, or as soon as the site is in use, delivery counts as accepted.
I fix errors in what I built free of charge up to 30 days after delivery. New wishes are not included.
6. Ownership
Once paid in full, the design, content and code made specifically for you are yours. Generic building blocks I use across projects stay mine; you get a permanent, free right to use them. Open-source software falls under its own licence.
I may show the project among my work, unless you’d rather I didn’t.
7. Hosting and maintenance
Subscriptions can be cancelled monthly, by email before the end of the current month. I take care of backups, updates and monitoring, but can’t promise uninterrupted availability: hosting providers and networks are beyond my control.
You remain responsible for what you publish on the site yourself.
8. Liability
My liability is limited to the amount of the job concerned, or for subscriptions to the amounts of the last 12 months. I am not liable for indirect damage, such as lost profit, nor for third-party services (hosting, payment providers, email). This does not limit liability for intent or gross negligence, nor any mandatory consumer rights.
9. If you are a consumer
If you conclude a distance contract as a consumer, you have a 14-day right of withdrawal. If you expressly ask me to start within that period, you pay for the work already done when you withdraw. The statutory guarantee still applies.
10. Privacy, law and disputes
How I handle data is set out in the privacy policy. Belgian law applies. In a dispute we first look for a solution together; failing that, the courts of my business’s registered office have jurisdiction, unless the law gives a consumer another court.
